CONDITIONS of SALE
1. TERMS
A. A one-third deposit is required to confirm each sale, unless
third party financing is approved and utilized. Meg Brown Home
Furnishings accepts Visa, Mastercard, American Express and approved
checks for your deposit. A $30 fee will be charged on all returned
checks. Meg Brown Home Furnishings retains a security interest in
the merchandise pending payment.
B. Balances are due upon delivery if the furniture is being
delivered on a Meg Brown Home Furnishings' truck. If an order is
shipped from an outside carrier, the balance will be due by
certified funds before the furniture ships. Freight charges are due
to the outside carrier upon delivery. Balances cannot be paid with
cash, credit cards, or third party financing.
C. Meg Brown Home Furnishings also offers financing programs through
third party finance companies. If you choose to take advantage of
this financing and your application is approved, payments must be
made to the finance company on or before the due dates in order to
avoid penalties in accordance with the terms of the financing
agreement.
D. All sales tickets are checked for accuracy. Errors in arithmetic
or pricing are subject to correction with your approval. In the
event you do not approve, Meg Brown Home Furnishings reserves the
right to to cancel the sale.
E. Meg Brown Home Furnishings can provide you with an estimated
delivery time on special orders. Unfortunately, these dates often
change based on factory production schedules and other issues beyond
our control. We cannot be held responsible for changes in lead times
or factory delays.
2. DELIVERIES
A. Please note the size of the merchandise and make sure that it
will easily fit through all passages necessary for delivery. Meg
Brown Home Furnishings cannot be responsible for items that will not
fit into your home. If delivery involves limited maneuverability,
Meg Brown Home Furnishings will not be liable for damages that might
occur from attempting delivery. The customer is responsible for
notifying Meg Brown Home Furnishings of any special delivery
conditions. You are responsible for any additional delivery help,
equipment, tolls, or transportation charges that may be required to
deliver your furniture. Meg Brown Home Furnishings cannot be
responsible for deliveries made by outside carriers.
B. Customers must report any damages or defects at the time of
delivery and note them on the delivery ticket. Delivery personnel
may be able to make adjustments and fix minor problems. If they
cannot correct them, please call us for authorization to return the
damaged or defective item only for deluxing, repair, or replacement
at our discretion. You will not be charged a re-delivery charge
unless the merchandise met manufacturer's quality standards.
C. Customer pickups may require certified funds. Meg Brown Home
Furnishings reserves the right to refuse to allow pickups in rented
trucks. Customers waive any claims for damages or defects on all
customer pickups. Meg Brown Home Furnishings cannot be responsible
for securing furniture to your vehicle.
D. Orders not delivered within 30 days of their arrival at our
warehouse must be paid in full and will incur a storage charge of 2%
of the total order per month.
3. ORDER CANCELLATION
Orders cannot be changed or cancelled once placed. A restocking fee
of one-third of the purchase price will be charged on all
cancellations. Customer's own material (COM) cannot be cancelled or
refunded.
4. WARRANTY
A. Meg Brown Home Furnishings warrants its merchandise to meet
manufacturers' warranty standards. Manufacturer warranties do not
apply to "AS IS" merchandise.
B. We cannot warrant the wearing ability, stretching, shrinking, or
color-fastness of fabric or leathers, as the manufacturer does not
guarantee them. Dye lots of leather and fabric may vary from our
swatches, therefore we cannot assume responsibility for shade
variations. Many leathers require routine cleaning. Please check
with Meg Brown Home Furnishings for instructions on cleaning
specific leathers.
C. Warranties on mattresses do not cover body impressions or
comfort. Please see your specific warranty information for more
details.
D. Meg Brown Home Furnishings cannot assume responsibility for
wall-hung mirrors or accessories after installation due to the
nature of wall construction.
E. Meg Brown Home Furnishings cannot guarantee matching items due to
grain and color variations in wood and leather.
F. No warranty or change of terms and conditions either expressed or
implied shall be valid unless documented on your order contract and
approved by management. Your order contract supersedes any and all
written and verbal representations.
5. REFUNDS and CREDITS
A. All authorized refunds of cash or check payments will be made
within two weeks of cancellation or return of the merchandise. Cash
refunds cannot be given.
B. All other authorized refunds will be credited to the originally
charged account within two weeks of the cancellation or return of
the merchandise.
